1. Acceptance of Terms

By accessing or using DecodeETF (the “Site”), you agree to be bound by these Terms of Use and Disclaimer (the “Terms”). If you do not agree with any part of these Terms, you must not use the Site. DecodeETF reserves the right to modify these Terms at any time without prior notice. Continued use of the Site following any modification constitutes your acceptance of the revised Terms.

2. Not Financial Advice

Nothing on this Site constitutes financial, investment, tax, legal, or any other form of regulated advice. All content, data, tools, analysis, commentary, and materials published on DecodeETF are provided for informational and educational purposes only and should not be construed as a recommendation, solicitation, or offer to buy or sell any security, fund, or financial product.

DecodeETF is not registered as an investment adviser, portfolio manager, exempt market dealer, or in any other capacity regulated under the Securities Act (Ontario) or equivalent provincial legislation, or under the Investment Industry Regulatory Organization of Canada (CIRO), or any other Canadian or international regulatory authority.

3. Data Accuracy & Reliability

Data displayed on the Site is sourced from third-party providers including, but not limited to, Yahoo Finance (yfinance), TMX Group, and public ETF filings. DecodeETF makes no representation, warranty, or guarantee—express or implied—as to the accuracy, completeness, timeliness, or reliability of any data, price, return figure, AUM, holding weight, sector classification, geographic allocation, or any other information presented on the Site.

Data may be delayed, incomplete, rounded, estimated, or otherwise imprecise. ETF holdings, sector exposures, and geographic breakdowns are derived algorithmically and may differ from figures published by the fund manager or other authoritative sources. Always verify data directly with the ETF provider or your brokerage before acting on it.

4. Limitation of Liability

To the maximum extent permitted by applicable law, DecodeETF, its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

  • your use of, or inability to use, the Site or any content thereon;
  • any errors, omissions, inaccuracies, or delays in data or content;
  • any investment or financial decision made in reliance on information from the Site;
  • any loss of profits, revenue, data, or goodwill;
  • any interruption, suspension, or termination of the Site or any feature thereof.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if DecodeETF has been advised of the possibility of such damages.

5. No Warranty

The Site and all content are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

6. Third-Party Content & Links

The Site may reference or link to third-party websites, data providers, ETF providers, or other resources. DecodeETF has no control over the content or practices of such third parties and accepts no responsibility for them. The inclusion of any link does not imply endorsement by DecodeETF.

7. Intellectual Property

All original content, design, source code, and tooling on the Site is the property of DecodeETF and may not be reproduced, distributed, or used for commercial purposes without express written permission. ETF names, fund family names, index names, and related trademarks are the property of their respective owners and are used for identification purposes only.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Ontario.
